Divine AI ("Service") is operated by Divine Media ("Company," "we," "us," or "our"). We are committed to protecting your privacy and handling your data with transparency. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data.

2. Information We Collect

2.1 Information You Provide Directly

  • Account information: Name, email address, phone number, and messaging platform identifiers when you apply for and use the Service
  • Conversation data: Messages, files, images, and other content you send to your AI assistant through Telegram, WhatsApp, iMessage, or other supported channels
  • Preferences and instructions: Communication style preferences, scheduling information, and task-specific data you share with your assistant
  • Payment information: Billing details processed through our payment provider (we do not store full credit card numbers)

2.2 Information from Connected Services

With your explicit permission, your assistant may access data from services you connect, including:

  • Email (Gmail, Outlook) for reading, drafting, and sending messages on your behalf
  • Calendar for scheduling and availability management
  • File storage (Google Drive, Dropbox) for document access and creation
  • Other third-party services you authorize

2.3 Automatically Collected Information

  • Usage data: Interaction frequency, feature usage patterns, and task types
  • Technical data: Device type, messaging platform version, and connection timestamps
  • Token usage: AI model usage metrics for billing and quality purposes

3. How We Use Your Information

We use your information to:

  • Provide, maintain, and improve the Service
  • Personalize your assistant's behavior and responses based on your preferences
  • Process your requests and execute tasks on your behalf
  • Maintain conversation context and memory for continuity
  • Process payments and manage your subscription
  • Communicate with you about your account and service updates
  • Monitor for abuse, fraud, and terms violations
  • Improve our AI models and service quality (using anonymized, aggregated data only)

4. Third-Party AI Providers

The Service uses third-party AI providers including OpenAI and Google to process your requests. When your messages are processed:

  • Your conversation content is sent to these providers' APIs for processing
  • These providers have their own data handling policies (see OpenAI Privacy Policy and Google Privacy Policy)
  • We use API access (not consumer products), which means your data is not used to train their models under current API terms
  • We select providers and configurations that prioritize data privacy

5. Data Sharing

We do not sell your personal data. We may share your information only in these circumstances:

  • Service providers: Third-party AI providers, payment processors, and infrastructure providers necessary to deliver the Service
  • Legal requirements: When required by law, court order, or governmental regulation
  • Safety: To protect the rights, property, or safety of our users, the public, or our company
  • Business transfers: In connection with a merger, acquisition, or sale of assets (with prior notice)

6. Data Security

We implement industry-standard security measures including:

  • Encryption in transit (TLS/SSL) for all communications
  • Encrypted storage for sensitive data at rest
  • Access controls limiting who can view customer data
  • Regular security audits and monitoring
  • Isolated customer environments preventing cross-customer data access

No system is 100% secure. While we take reasonable measures to protect your data, we cannot guarantee absolute security.

7. Data Retention

We retain your data as follows:

  • Active accounts: Conversation history and preferences are retained for the duration of your subscription to maintain assistant context and quality
  • After cancellation: We retain your data for 30 days after account termination, during which you may request an export. After 30 days, data is permanently deleted
  • Billing records: Retained for 7 years as required by tax and accounting regulations
  • Anonymized usage data: May be retained indefinitely for service improvement

8. Your Rights

You have the right to:

  • Access: Request a copy of the personal data we hold about you
  • Correction: Request correction of inaccurate personal data
  • Deletion: Request deletion of your personal data (subject to legal retention requirements)
  • Export: Request your data in a portable, machine-readable format
  • Restrict processing: Request that we limit how we use your data
  • Object: Object to processing of your data for certain purposes
  • Withdraw consent: Withdraw previously given consent at any time

9. Cookies and Tracking

The Service uses the following cookies and tracking technologies:

  • Session cookies: Essential for authentication and maintaining your login state. These expire when you close your browser or after your session times out
  • Analytics: We use privacy-focused analytics (Umami) to understand aggregate usage patterns. This does not use cookies and does not track individual users across sites
  • Third-party cookies: Our payment processor (Stripe) may set cookies during the checkout process. We do not use advertising cookies, social media trackers, or retargeting pixels

You can control cookies through your browser settings. Disabling essential cookies may prevent you from using the Service.

10. California Residents (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • The right to know what personal information we collect, use, and disclose
  • The right to request deletion of your personal information
  • The right to opt out of the sale of personal information (we do not sell personal information)
  • The right to non-discrimination for exercising your CCPA rights

11. European Residents (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR):

  • Legal basis for processing: We process your data based on (a) your consent, (b) performance of our contract with you, (c) compliance with legal obligations, and (d) our legitimate interests in operating and improving the Service
  • Data portability: You have the right to receive your personal data in a structured, commonly used, machine-readable format
  • Right to erasure: You may request that we delete your personal data, subject to legal retention requirements
  • Right to restrict processing: You may request that we limit the processing of your personal data
  • Right to object: You may object to processing based on legitimate interests
  • Automated decision-making: The AI assistant processes your requests using automated systems. You have the right to request human review of any significant automated decision
  • Supervisory authority: You have the right to lodge a complaint with your local data protection authority

12. Children's Privacy

The Service is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a child under 18, we will delete it promptly.

13. International Data Transfers

Your data may be processed in the United States and other countries where our service providers operate. By using the Service, you consent to the transfer of your data to these jurisdictions, which may have different data protection laws than your country of residence. Where required by applicable law, we implement appropriate safeguards for international transfers, including standard contractual clauses.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes at least 14 days before they take effect through your messaging platform or email. Your continued use of the Service after changes take effect constitutes acceptance.

15. SMS Messaging Program

Divine AI offers an optional SMS notification service that allows your AI assistant (Felix) to send you text messages including daily briefings, task confirmations, meeting reminders, and important alerts.

Opt-In: SMS consent is collected separately and voluntarily through your account dashboard settings (Settings → Notifications). You must actively check an unchecked consent box to opt in. SMS consent is not required to use the Divine AI service.

Message Frequency: Varies based on your activity and preferences. Typically 1–5 messages per day.

Message and Data Rates: Standard carrier message and data rates may apply.

Opt-Out: Reply STOP to any message to unsubscribe immediately, or disable SMS in your dashboard settings.

Help: Reply HELP to any message, or email [email protected].

Data Sharing: Mobile opt-in data and consent will not be shared with, sold to, or used by any third parties for marketing purposes. Your phone number is used solely to deliver the SMS notifications you have consented to receive.
