By accessing or using Divine AI services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. Divine AI is operated by Divine Media ("Company," "we," "us," or "our").
Divine AI provides a premium, AI-powered personal assistant service delivered through messaging platforms including Telegram, WhatsApp, and iMessage. The Service includes task execution, research, scheduling, document creation, image generation, and other capabilities as described on our website.
The Service is provided on a subscription basis across three tiers: Foundation, Professional, and Business. Features, capabilities, and model access vary by tier.
The Service is available by application only. We reserve the right to accept or decline any application at our sole discretion. You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
Access credentials, API keys, and bot connections are personal to your account and may not be shared, transferred, or resold.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to:
Without limiting the generality of Section 4, the following activities are expressly prohibited when using the Service or directing your AI assistant ("Felix" or any assigned assistant name). Violation of any of these prohibitions may result in immediate suspension or termination of your account without refund.
We reserve the right to monitor usage patterns for compliance with these prohibitions. If we determine that your use of the Service violates any of these terms, we will notify you and may take corrective action including content removal, feature restriction, account suspension, or permanent termination at our sole discretion.
You are solely responsible for all instructions given to your assistant and all actions taken by your assistant on your behalf. "I didn't know my assistant would do that" is not a defense against violations of these terms.
Each subscription tier includes defined usage parameters including model access, context windows, and monthly interaction budgets. We implement per-task token budgets and monthly caps to ensure fair use and service quality for all customers.
If your usage consistently exceeds the parameters of your tier, we may recommend an upgrade, throttle response quality, or adjust your service accordingly. We will notify you before making any changes.
Excessive or abusive usage that degrades service quality for other customers may result in temporary suspension or termination of your account.
Subscription fees are billed monthly in advance. All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days' written notice.
If payment fails, we will attempt to notify you and provide a 7-day grace period before suspending service.
Your conversations, files, and data processed through the Service are treated as confidential. We do not sell your data to third parties. However, the Service relies on third-party AI providers (including OpenAI and Google) whose own terms and privacy policies apply to data processed through their APIs. We retain conversation history to maintain context and improve your assistant's performance. You may request deletion of your data at any time by contacting us.
You are responsible for not sharing sensitive information (passwords, financial account numbers, Social Security numbers) through the Service unless you accept the inherent risks of AI-processed data.
Content you create using the Service belongs to you, subject to the underlying AI providers' terms. The Service itself, including its configuration, prompts, workflows, and branding, remains the property of Divine Media.
AI-generated content (images, text, documents) may be subject to limitations on copyright protection under applicable law. We make no guarantees regarding the copyrightability of AI-generated outputs.
The Service is provided "as is" and "as available." While we strive for reliability and accuracy, we cannot guarantee:
You acknowledge that AI systems can produce incorrect, biased, or unexpected outputs. You are responsible for reviewing and verifying any information or content produced by the Service before relying on it for important decisions.
To the maximum extent permitted by law, Divine Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms (including the Prohibited Uses in Section 5), engage in abusive usage, or fail to pay subscription fees.
Upon termination, we will provide a reasonable period (14 days) for you to export your data. After that period, we may delete your data in accordance with our data retention policy.
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Charlotte, North Carolina.
